The customer automatically accepts this sales agreement by buying, placing an order or making purchases in any other way within this Site. The terms and conditions of this sales agreement are subject to change without notice; the terms and conditions deemed valid are in any case those shown at the time the customer places an order.

Prices, configurations, technical and aesthetic characteristics can be changed at any time, due to market changes or typing errors.
If there were any photographic and / or textual errors on the site, NCT will inform you at the time of the order.
All orders are subject to acceptance by NCT.
2. Mode of transport and delivery
NCT products travel with international couriers, the best transport services chosen to guarantee maximum professionalism and speed of delivery.
Transportation costs are variable because they depend on the destination, quantity, weight and size of the goods.
The locations considered by the disadvantaged haulier may result in higher fares and longer delivery times than normally expected.
The operators of NCT are however at your disposal to let you know at any time the exact amount of these expenses.
Important
Delivery times refer to products available in stock at the time of ordering.
You can use the “Delivery to the floor” service. The cost of this service is commensurate with the weight of the shipment and is not included in the transport costs. It is therefore necessary to request it before the order in order to calculate the amount separately.
The driver is required to unload the goods from the truck but NOT to transport the packages inside.
Even if drivers are available to help, it is necessary that at your delivery there is always one of your employees to receive and handle the goods.
The customer must verify that the package is intact, not damaged or wet and in any case complies with the standard features. Only after this verification will the customer have to sign the delivery note, after which he can not make any objection to NCT.
If the courier does not allow the opening of packages and in case of damage to the packaging of the products, the transport document or accompanying invoice must be signed with “reservation of control” and always sent by fax to +39 0541 851289. In otherwise there will be no substitution of goods or refunds.
It is mandatory to send the order to communicate any different destinations and indicate if the delivery area is in some way “uncomfortable” (particularly narrow streets, limited traffic areas, pedestrian areas, etc.).
Later changes of destination will not be accepted.
All changes not agreed with NCT and the unjustified loss of time of the carriers will be quantified and charged on the invoice.
3. Prices and methods of payment
All prices of the items offered by NCT are expressed in Euro, excluding VAT, and VAT included, and refer exclusively to purchases made over the Internet.
NCT reserves the right to change prices at any time as a result of market changes or typographical errors.
Although NCT checks and if necessary changes the price list every day, the already completed orders will not be subject to price changes.
The possible forms of payment are:
advance bank transfer within 24 hours from order confirmation;
the copy of the payment by bank transfer must show the CRO number
issued by the bank and must be sent by fax to +39 0541 851289 or via
e-mail to info@nctchemical.com;
paypal
credit card (only for orders placed directly online);
cash on delivery with cash or bank draft;
in the latter case it will be necessary to send by fax to +39 0541 851289, before shipment, copy of the check which will then be delivered to the
courier upon receipt of the goods.
Cash on delivery is not required for orders over 1,000
euro, for which it is necessary to pay a deposit equal to 65% of the total.
NCT, at its sole discretion, reserves the right to request payment in advance or to grant cash on delivery.
In case of late payment, legal interest will be charged.
4. Guarantees and right of withdrawal
Each purchase transaction will be regulated by the provisions of Legislative Decree 22 May 1999, n.185 (consumer protection law in contracts concluded
at a distance) and, therefore, the Customer will be the holder of a right of withdrawal, exercisable within the terms and according to the procedures established by the aforementioned law (Article 5). The request for withdrawal (downloadable form) must be sent by registered mail to the address, NCT New Chemical Technology via Manzetti sn- Zona Ind. Casarola – 47832 San Clemente (RN) ITALY, anticipated by email sent to info@nctchemical.com, to the attention of the Sales Manager. In the request for withdrawal, the correct personal data of the user must be reported (Name, Surname, Address, Tax Code).
The customer will be able to cancel within 10 (ten) days from the receipt of the goods, and will have the right to the restitution of the sum paid, minus the management costs of the practice quantified at a flat rate of 5.00 Euros. For the 10-day period indicated above, only the date of the registered post with which the withdrawal is communicated will be valid.
The return of the amount paid, in case the product has already been shipped, will only take place when the returned goods are returned to NCT, which must be sent back intact. The returned products MUST be 100% complete, contain ALL the boxes and the original packaging and all the accessories and documentation provided by the manufacturer.
If the goods were damaged on delivery it is recommended to REFUSE to the courier who takes care of the delivery. If you accept the package, make sure that it is noted on the courier’s register in order to allow NCT to request a refund for damages. If the damaged goods are not reported to NCT within 10 days, the rule provided for in this agreement will be applied for the exercise of the right of withdrawal that will cancel any request for damages.
In case of DEFECTIVE goods, this can be returned to NCT within 10 days of receipt of the same. At the discretion of NCT, the goods may be replaced or if not reimbursed.
The transport costs on returned goods are charged to the customer, while NCT will bear the costs of transporting the replaced goods. The right of withdrawal does not include shipping costs, because shipping is an additional service and therefore non-refundable. We inform you that rejecting the package is not the same as making use of the right of withdrawal.
Important
Upon delivery, the customer is obliged to view the external packaging.
If this presents alterations the goods must be accepted with reserve right and immediately communicated to NCT.
If the packaging does not present any external alterations, the customer has the obligation to view the goods within the day of delivery.
If the goods are damaged, the customer must promptly notify NCT in the manner indicated in this agreement.
If the above instructions are not followed, NCT will not be responsible for any damage found.
5. Compliance with current legislation and legal warnings
All products distributed by NCT comply with current regulations and NCT, upon request, is available to certify the evidence.
In any case of force majeure or unforeseeable circumstances, the company will not be held responsible for the delay or non-delivery and reserves the right to terminate the contract in whole or in part, suspend or delay its execution.
Those who visit www.nctchemical.com and make use of the products and services offered on the site, accept that any relationship derives from it is governed by Italian law and that any dispute is submitted to the competent court of Rimini.
